User Agreement

1. Our Website
   1. Your use of this website and any service contained within constitutes acceptance of these Terms & Conditions. You will only be allowed access to site and it’s functions by agreeing to this when you first log in.
2. Drinker Information
   1. You should always check that the contact information you provide is correct before creating a drinker account or proceeding to payment.
   2. You are responsible for maintaining your own username and password, where required to access your drinker account. You should ensure that you store your username and password securely and that the details required to access your drinker account are not provided to another party.
   3. As a drinker you are responsible for your drinker account and actions taken within it. If you are aware or suspect that your drinker account username and password or other details have become known to a third party, you should inform us immediately.
   4. Our website is only intended for use by adults.
   5. For all users we require certain basic information to allow us to connect and perform searches on our database. We keep this to a minimum with very few mandatory fields.
      1. Postcodes - Required to compute distances from one user to another for presentation in search requests
      2. E-mail address - Required to communicate account information and product availability alerts.
      3. Phone number - Required to send Text alerts to your mobile. This will not be required if you only wish to have e-mail alerts.
3. Brewers
   1. Your brewery details, logo’s, beer descriptions and ABV’s need to be entered once (only) onto the system. By doing this, you agree to our use on an ‘as is’ basis to provide availability information to other users.
   2. YourRound will not modify in any way the information you have provided and you will be responsible for the content.
   3. All intellectual property remains with the originator of the information and a disclaimer to that effect will appear on the website main page.
4. Publicans
   1. Your pub logos and details need to be entered once (only) onto the system. Your list of currently available product will require to be maintained by you. You are required to remove a beer from the list when it is no longer available to avoid clutter on BeerCAM and Beer board displays.
   2. You will be able to add up to 20 beers at a time, for more than 20 please contact our admin team.
   3. Any beers that are not removed within 14 days will be automatically removed unless flagged as a regular beer.
   4. We will use your information to inform users when your available products match their requirements.
   5. You will not have access to the details of other users, but you may contact them via the website if they have agreed to be contacted in that way.
5. Drinkers
   1. Correct pricing of product is the responsibility of the publican. We do not set these prices and will not be responsible if actual product prices vary from those shown.
   2. Correct description and ABV figures for product is the responsibility of the publican. We do not set these and will not be responsible if actual product varies from those shown.
6. Drinker Complaints
   1. We endeavour to respond to all drinker complaints or queries within five working days.
7. Events outside our control
   1. ITQ Web Ltd shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.
8. Licence
   1. ITQ Web Ltd grants users a licence to access the content, information and services contained within our website for personal and business use.
   2. This licence allows you to download and cache (using your browser) individual pages from our website.
   3. This licence allows publicans to include links to the WebCAM™ and Beer Boards on their own website free of charge.
   4. This licence does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.
   5. Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.
   6. Our website cannot be placed within the frame-set of another site.
   7. Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.
   8. The restriction on “deep linking” does not apply to affiliate partners who wish to send drinkers directly to a particular page or product in order to increase their affiliate sales.
9. Copyright
   1. All content, databases, graphics, buttons, icons, logos, layouts and look & feel are the copyright of ITQ Web Ltd, unless expressly acknowledged as otherwise.
   2. The BeerCAM logo and YourRound roundel device are trade marks of ITQ Web Ltd.
   3. The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.
10. Waiver
    1. Failure by ITQ Web Ltd to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing.
11. Entire Terms & Conditions
    1. These Terms & Conditions set out the entire agreement and understanding between you and ITQ Web Ltd. We reserve the right to change these Terms & Conditions at any time, without giving notice to you.
12. Jurisdiction
    1. These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
